Terms of service

Effective 5 September 2026. These terms govern the use of Kliniqo by a laboratory and its staff.

1. Who we are, and what this is

Kliniqo is laboratory information software provided as a subscription by Priyam Rupapara, trading as Kliniqo, Rajkot, Gujarat, India (“we”, “us”). The “Service” is the web application, the patient and doctor portals, the analyser agent and the messaging features described on our website. By creating a laboratory account or using the Service you (“the Laboratory”, “you”) agree to these terms.

2. What the Service is — and is not

The Service records, calculates, formats, stores and transmits information that the Laboratory and its staff enter or its instruments produce. It does not perform tests, interpret results, or sign reports. Every clinical decision — what to test, what a result means, whether a report is released — is the Laboratory's and its pathologist's, under their own registrations and the law that applies to them.

3. Accounts and access

  • The Laboratory's owner opens the account and decides who else may sign in and what each person may do.
  • Each staff member keeps their own password and, where enabled, their own authenticator. Sharing accounts is not permitted.
  • Patients reach their reports with their mobile number and date of birth; doctors with the credentials the Laboratory issues. The Laboratory is responsible for the accuracy of the mobile numbers and dates of birth it records, because those are the keys.
  • You will tell us promptly of any unauthorised use of your account.

4. The Laboratory's responsibilities

  • Holding the registrations and qualifications the law requires of a pathology laboratory and its signatories.
  • Obtaining and recording each patient's consent to be contacted on WhatsApp, and to any sharing of their reports.
  • Verifying every result and report before release. The Service flags, warns and holds; it does not decide.
  • Keeping its own copies of anything it is required to retain by law, using the export features provided.
  • Using the Service lawfully, and not to store or send content that is unlawful, misleading or infringes another person's rights.

5. Our responsibilities

  • To run the Service with reasonable skill and care, and to work to restore it promptly when it is unavailable.
  • To store the Laboratory's data in India, to isolate it from every other laboratory's, and to process it only as our privacy policy describes.
  • To keep backups and to be able to restore from them.
  • To tell you about changes that affect how you work before they happen, wherever that is possible.

6. Fees and payment

  • Prices are those shown on our pricing page on the day you subscribe, in Indian rupees, per laboratory, per year. Taxes, where they apply, are shown separately on the invoice.
  • A trial is free. A subscription begins on the day the Laboratory goes live and is paid in advance for the year.
  • A plan may be changed at any time; a move to a higher plan takes effect at once and is charged for the remainder of the year.
  • Cancellation and refunds are governed by our cancellation and refund policy.
  • Messages sent through the Laboratory's own WhatsApp number are billed to the Laboratory by Meta under Meta's terms, not by us.

7. Data and privacy

The Laboratory is the data fiduciary for its patients' information under the Digital Personal Data Protection Act, 2023; we process that information on the Laboratory's behalf and instructions, as described in our privacy policy, which forms part of these terms. The Laboratory's data belongs to the Laboratory. We do not sell it, and we do not use it for any purpose other than providing the Service.

8. Term, suspension and ending

  • These terms apply for as long as the Laboratory has an account.
  • We may suspend an account that is used unlawfully, that endangers the Service or other laboratories, or whose subscription is unpaid after reminders. We will say why.
  • Either side may end the subscription at the end of the paid year by notice. After it ends the Laboratory may export its data for ninety days; after that we delete it, except what the law requires us to keep.

9. Intellectual property

The Service, its code, its designs and its documentation are ours or our licensors'. The Laboratory's data, its rate card, its report templates and its website content are the Laboratory's. Each side grants the other only the rights needed to provide and use the Service.

10. Warranties and limits

We provide the Service with reasonable care, but software is never perfect and the internet is never always up. To the extent the law allows, we exclude other warranties, and our total liability to the Laboratory in any year is limited to the fees paid for that year. Nothing in these terms limits liability that cannot be limited by law, or for fraud, or for death or personal injury caused by negligence.

11. Indemnity

The Laboratory will indemnify us against claims arising from its use of the Service in breach of these terms or of the law, including claims by patients or doctors about the Laboratory's own tests, results and reports.

12. Changes to these terms

We may update these terms. A change that affects the Laboratory's rights or costs takes effect at the start of the next subscription year, after notice by email and inside the Service. Continued use after that date is acceptance.

13. Governing law

These terms are governed by the laws of India. The courts at Rajkot, Gujarat have jurisdiction. Both sides will first try to resolve a dispute by talking to each other.
